By accessing or using SMSPrep ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. We reserve the right to update these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

SMSPrep is an SMS-based educational platform that delivers daily practice questions, study reminders, and instant feedback to users via text message. The Service includes a free tier and paid subscription plans with additional features such as detailed explanations, progress dashboards, and parent monitoring tools.

3. Eligibility

The Service is available to individuals of all ages. Users under 13 years of age must have verifiable parental or guardian consent before creating an account or providing personal information. By using the Service, you represent that you either meet the minimum age requirement or have obtained the necessary parental consent.

4. Account Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must notify us immediately of any unauthorized use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

5. SMS Communications

By signing up for SMSPrep, you consent to receive text messages from us, including:

• Daily practice questions and study content.
• Feedback and explanations in response to your answers.
• Study reminders and engagement nudges.
• Account-related notifications (e.g., billing confirmations).

Opt-Out: You may stop receiving SMS messages at any time by replying STOP to any message. Standard message and data rates may apply depending on your mobile carrier.

6. Subscription Plans & Billing

6.1 Plans

SMSPrep offers a Free Plan, a Plus Plan ($9/month), and a Parent Plan ($15/month). Feature details for each plan are described on our pricing page and are subject to change.

6.2 Billing

• Paid subscriptions are billed monthly on the date of your initial purchase.
• All payments are processed securely through our third-party payment processor.
• You authorize us to charge your payment method on a recurring basis until you cancel.

6.3 Cancellation & Refunds

• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
• We do not provide partial refunds for unused portions of a billing cycle.
• If you believe a charge was made in error, contact us at support@smsprep.com within 30 days.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Transmit abusive, offensive, or inappropriate content through SMS replies.
• Attempt to reverse-engineer, disassemble, or decompile any part of the Service.
• Use automated systems (bots, scripts) to interact with the Service.
• Share your account credentials with third parties or create multiple accounts to circumvent plan limitations.
• Resell, redistribute, or commercially exploit the Service or its content without our written permission.

8. Intellectual Property

All content delivered through the Service — including questions, explanations, graphics, and software — is the property of SMSPrep or its licensors and is protected by copyright and intellectual property laws. You may not copy, modify, distribute, or create derivative works from our content without prior written consent.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

Educational Disclaimer: SMSPrep is a supplementary study tool. We do not guarantee specific exam results, grades, or academic outcomes. The Service is not a substitute for formal instruction, tutoring, or professional academic advice.

10. Limitation of Liability

To the maximum extent permitted by law, SMSPrep and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability for any claim arising from these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless SMSPrep, its affiliates, and their respective officers, directors, and employees from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except where prohibited by law.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice. Upon termination, your right to use the Service ceases immediately. Sections related to intellectual property, limitation of liability, indemnification, and governing law survive termination.
